These Terms of Use outline the rules and regulations for the use of 1st-Photography LLC's Website, located at https://www.1st-photography.com/.
Terms and Things to Know
By using 1st-Photography.com you agree that you have read and agreed to be bound by this agreement and will comply with all the terms and conditions. If You do not agree, then you are not permitted to access or use any part of the site or its services.
COVID-19
It is the responsibility of the user to notify 1st-Photography if there is any concern for health, as well as if a mask or any other precautions are needed prior to the date of service.
Let the Homeowner/Tenant Know
The person placing the order is responsible for making sure that everyone is aware a photographer is coming to a photo-ready home at a scheduled time. It is between you and your client to schedule a time, we on occasion will deal directly with your clients on scheduling but we prefer that you handle it all and order on the site to avoid any confusion.
Photo Ready
The customer agrees to have the listing clean, neat, and photo-ready prior to the photographer arriving at the appointment location. Our photographers will do their best to help with advice on things to move etc., but in some cases, if the listing isn’t ready, we will do what we can to take the best possible shots. Rescheduling/Cancellation
With a 24-hour or more notice, you will not incur any fees. If the order is canceled or rescheduled with less than a 24-hour notice of the scheduled time, there will be a $50 fee. If the job is canceled or rescheduled while the photographer is on-site, there is a $50 cancelation fee plus any mileage charges that may have occurred.
Rainy Day Policy
In the event of inclement weather, our photographers will stay on schedule, unless canceled or rescheduled by the client. We have free same-day cancellations for bad weather conditions but must be canceled 2 hours or more prior to the scheduled appointment. We will take all required photos interior and exterior. If a retake of the exterior is needed or drone photography/videography was ordered, we will come back at a newly scheduled time to complete the job with a trip fee ($50) added to the 2nd trip. As always if this is outside of our normal working radius, mileage will also be added. (Please call the office to reschedule, the photographers are unable to update schedules)
Onsite Order Changes
If the customer changes anything on the order while we are onsite, the photographer (if able to) will complete the extra tasks and the client will be billed the additional services.
Who owns the Photos?
All photos provided to the clients through 1st-Photography.com are solely and exclusively owned by 1st-Photography Marketing. As such, 1st-Photography Marketing reserves all rights of ownership including but not limited to the distribution, publication, alteration, sale, resale, and duplication of all photos provided to you. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of 1st-Photography Marketing.
But of course, we want you to use the edited photos you paid for, please use them in all your Marketing now and in the future. You can use it for your marketing, social media posts, and MLS listings. You cannot resell or claim ownership of the photos without prior agreement.
How Long do we keep the Photos?
We will keep the photos for 30 days after delivery, after the 30 days there is no guarantee that we can provide the photos to you again.
